Sønderborg Municipality wants to sell the former Materiale Gård, land register 591 Skodsbøl Broager, as the property is no longer used by the municipality. 

 

Land plot no. 591 Skodsbøl Broager consists of a plot of land of 5186 m2, on which there are three buildings.

Building 1 is a warehouse with a workshop and office.

Building 2 is a storage building for salt storage which is open on one side.

Building 3 is a steel hall.

 

The land was previously used as a Material Farm, but the relationship has ended. 


There is a minimum bid of 2.500.000 kr.

  • The local plan enables, among other things, establishment of porter accommodation in connection with smaller craft businesses. 
  • The area is covered by urban planning statute no. 5, Cf. According to the town planning statute, the area may only be used for residential and craft purposes, and only open and low-rise buildings may be built. On each property, a home for one family with associated buildings for small craft businesses (including a small sales room belonging to the business) may only be built or furnished, when the business does not cause inconvenience to the residents through dust, smoke, smell, noise, vibrations .

Special conditions

  • Stålhallen at Håndværkervej 1A: The buyer is made aware that the steel hall on the property must be legalized immediately after the handover, as there is no building permit. The building is located too close to the border with neighboring land and does not meet applicable fire requirements. The legalization must be done either physically (e.g. by demolition), legally or as a combination of these.

 

  • Legalization of steel hall solutions

Sønderborg Municipality has had a technical note prepared by HOBSON consulting engineer. This is stated in the tender documents.

The technical note only deals with the fire conditions around the steel hall, which is located close to the boundary and which must be legalized.

It appears from the memorandum and tender documents that the steel hall as it stands today is not a legal structure. To legalize the steel hall, there are three general solution models:

  • An REI 120 fire wall is constructed where the building is closer to the boundary and the center of the path and road than 2,5 m.
  • Building code boundary, which ensures a distance to the boundary of at least 2,5 m. (this requires a supplement, see Appendix 4 to BR18, which is carried out by a BK3 fire consultant).
  • Demolition of steel hall.

 

The note provides indicative estimated prices for the various solution models. Please note that these are only indicative estimated prices.

 

The buyer is advised to contact a fire and building technical advisor, where the buyer can obtain information about the specific measures and finances that must be expected to legalize the steel hall. The buyer is encouraged to have this clarified before submitting his bid for the property.

To apply for a building permit for legal legalization, a building application must be submitted, accompanied by official drawings and a classification of fire and construction class. The application is submitted via the Building and Environment application portal at: bygogmiljoe.dk. It is recommended that the buyer uses a building technical advisor to prepare the application material. A demolition permit must also be applied for if physical legalization is desired.

The buyer must apply for legalization of the property immediately after the purchase agreement has been signed by both parties and no later than when the property is transferred to the buyer.

The steel hall may not be used until it has been legalized via a building and commissioning permit.

 

 

  • Exemption from the local planBased on drawing material including material descriptions, plumbing description, copy of neighbor consultation and tender material, an exemption from the local plan has been granted. The exemption is attached to the tender documents.

 

  • Requirements for a water management plan: Prior to any new construction, demands may be made for a water management plan in accordance with Sønderborg Municipality's Climate Adaptation Plan.
     
  • Registered siren system: The property has a registered warning siren, which the buyer must respect. The National Emergency Management Agency has an irrevocable right of access for operation and maintenance of the facility.
     
  • Environmental conditions: If the buyer wishes to use the washing area on the property, this must be covered and a new oil separator must be established. Alternatively, the oil separator must be blinded or removed. Existing oil separators on the site are already blinded and cannot be used.
     
  • Legalization deadline: The buyer must have started legalizing the steel hall within three months of taking over. If this does not happen, Sønderborg Municipality will be able to initiate an enforcement process, which may ultimately lead to an order for physical legalization. Costs for legalization, including demolition, are borne by the buyer.
  • Rental option

    The area is zoned as "Craftsmen's Area". In Partial City Planning Bylaw No. 5.

    The local plan does not regulate ownership. It will therefore be possible to rent the property, or parts of it, to other business operators. This is, however, on the condition that their business complies with the use regulations and other provisions.

    Regarding use, the local plan states the following for area B (where the property is located):

    §2, a: The area may only be used for residential and craft purposes, and only open and low-rise buildings may be constructed. On each property, only one dwelling for one family may be constructed or furnished with associated buildings for small craft businesses (including a small sales room belonging to the business), if the business does not, by dust, smoke, smell, noise, vibrations or by its appearance or in any other way, in the opinion of the municipal council, be a nuisance to the residents living nearby. The businesses may only be operated by others than the person who lives in the dwelling on the property with the special permission of the municipal council.

    According to the final sentence of the provision: The businesses may only be operated by persons other than the person who resides in the residence on the property with special permission from the municipal council. Sønderborg Municipality states that this sentence only relates to the establishment of any concierge residences and who in that case may operate the business to which the concierge residence is attached. The area should be seen as a primary business area. It will therefore be possible to operate a business on the property yourself, and to rent out excess space to other businesses.

    The local plan does not contain extraordinary provisions, such as noise limits, that would prevent the establishment of, for example, a workshop or carpentry business. Any exceedance will only be clarified in connection with a possible complaint.

 

  • The crane in the workshop hall is included in the offer for the property: The crane was disconnected in connection with the vacating of the property, but has been serviced in accordance with the regulations until then. Before commissioning, the buyer must ensure that it is serviced. and approved again.

Payment

  • The buyer receives an invoice in e-Boks approximately 14 days before the takeover date.
  • The payment deadline will typically be 3 days before the agreed takeover date.

Minimum price sale 2024

  • Minimum price 2,5 million DKK
    The buyer must indicate in the purchase agreement a proposal for determining the amount for land and buildings

 

When can the property be taken over

The sale takes place with immediate takeover and a maximum of 3 months after the purchase offer is submitted.

What are the planning frameworks

The property is located in urban zone and is covered by the following planning provisions:

  • Local plan no. 33
    The property is laid out as a craftsman's area. The local plan also enables the establishment of concierge housing in connection with smaller craft businesses.
     
  • Town planning statute no. 5
    This statute determines the overall use of the area and ensures that the development follows the provisions of the plan.
     
  • Municipal planning framework 6.1.002.E - Industrivez
    The area is reserved for heavy industry and crafts. 

The property can therefore be used for a wide range of business purposes within the established framework. However, the buyer is made aware that changes in the use of the buildings require an application for a building permit via the Byg og Miljø portal (bygogmiljoe.dk).

About the reason

The property consists of a plot of land of 5186 m² business area, centrally located in an area with mixed business. The plot is fenced and accessible via a gate which is included in the sale. However, the buyer must arrange for recoding of the lock themselves.

The property is V1 mapped, which means there is a potential risk of soil contamination. This means that an analysis obligation applies when moving land, which the buyer must be aware of. No further contamination investigations have been carried out on the site. However, the buyer has the option of carrying out his own investigations with the written consent of Sønderborg Municipality, provided that the area is re-established to its original condition after the investigations.

In addition, the property is registered as communal sewerage, but in the current waste water plan, the plot is planned for separate sewerage. Sønderborg Forsyning expects to initiate this separation in 2025. The buyer will then have one year to carry out separate sewerage on the property.

There are two oil separators on the property that are blinded and cannot be used. If the buyer wishes to use the property's washing area, this must be covered and a new oil separator must be connected to the waste water system.
